Electronic Records and Signatures Consent

This disclosure asks for your consent to receive records electronically and to sign them electronically, under the federal Electronic Signatures in Global and National Commerce Act ("ESIGN") and comparable state law such as the Uniform Electronic Transactions Act ("UETA"). Read it before you consent.
1. Scope of your consent
By checking the consent box, signing electronically in the Service, or continuing to use the Service after receiving this disclosure, you agree that Xrep.AI and the parties you transact with may provide to you electronically, and receive from you electronically:
- real estate purchase contracts, addenda, disclosures and related transaction documents;
- signature requests, signed copies and certificates of completion;
- notices, acknowledgements and other records related to a transaction;
- account, service and legal notices, including changes to our Terms of Service and Privacy Policy.
You also agree that your electronic signature on a document has the same legal effect as a handwritten signature, and that an electronic record satisfies any requirement that the record be in writing.
2. Hardware and software you need
To access and retain electronic records, you need:
- a current version of a major web browser (Chrome, Safari, Firefox or Edge) with cookies and JavaScript enabled;
- a connection to the internet;
- a valid email address that you monitor;
- software able to view PDF documents;
- a device with the ability to download and store, or print, files you wish to keep.
If these requirements change in a way that creates a material risk that you could not access or retain records, we will notify you and give you the chance to withdraw your consent without charge.
3. Getting paper copies
You may request a paper copy of any record we provided to you electronically by emailing info@xrep.ai with the document and transaction details. We do not currently charge a fee for this; if that changes we will tell you the fee before we send the copy. Requesting a paper copy does not by itself withdraw your consent.
4. Retaining records
You should download and save or print any electronic record you want to keep. Records remain available in the Service while your account and your organization's account are active; see the Privacy Policy for how long records are retained.
5. Withdrawing your consent
You may withdraw your consent to receive records electronically at any time by emailing info@xrep.ai with the subject line "Withdraw eSign Consent". Withdrawal takes effect once we have had a reasonable opportunity to act on it, and it applies going forward only — it does not affect the validity of records provided or signatures made before the withdrawal took effect.
Because the Service delivers and signs documents electronically, withdrawing consent means you will no longer be able to use it for transactions, and your access may be suspended. Other parties to a transaction may also require a separate consent.
6. Keeping your contact information current
Tell us promptly if your email address or phone number changes, by updating your account in the Service or emailing info@xrep.ai. We are not responsible for records you fail to receive because your contact information was out of date.
7. Signature providers
Signatures are collected through a third-party e-signature provider, currently Dropbox Sign or Documenso depending on your organization's configuration. Their signing pages and certificates of completion are subject to their own terms in addition to this disclosure.
